Munilla Lacasa, Salaber & de Palacios is a trusted adviser in terms of compliance and criminal liability of legal entities. His partner, Hernán Munilla Lacasa, has been a source of consultation in relation to the approval of the legal entities criminal liability law in Argentina. He has conducted training seminars for Judges and Prosecutors in the evaluation of integrity programs, and has also advised legal and compliance areas of more than a hundred companies in terms of adapting their compliance policies to the requirements of the current standards. Together with Vicente de Palacios, they co-direct the Strategic Criminal Compliance Committee of the Argentine Association of Ethics and Compliance.

The firm has had an active participation in the discussions of the legal entities criminal liability law in Argentina, since the bill started to be debated –in 2016- at the Ministry of Justice.

Hernán Munilla Lacasa also participated as a speaker, in his capacity as co-Director (together with Vicente de Palacios), of the Strategic Criminal Compliance Commission, of the Argentine Association of Ethics and Compliance, in the joint meeting of the Commissions on Criminal Legislation and General Legislation of the Argentine Congress (in relation to project nº 0127/16; 031-PE-2016), carried out on March 22nd, 2017. He also attended to such commission’s joint meeting on May 10th, 2017 on behalf of the Business Convergence Forum. Once the bill had half sanction (Deputies Chambers), he attended the National Senate as speaker representing IDEA in the meeting that took place in Illia Hall on August 9th, 2017.

He was also a speaker at the Internal Audit Commission Annual Meeting, organized by IDEA at the Sheraton Hotel in Buenos Aires, on August 24th, 2017, where he spoke about “New scenarios in terms of anti-corruption compliance”. On the same subject, he gave a talk at the Government of Organizations Division of IDEA, held at the entity’s headquarters on August 25th, 2017 and at the Christian Association of Business Leaders (ACDE), which took place at the headquarters of the Bar Association of the city of Buenos Aires, on September 12th, 2017.

Mr. Munilla Lacasa served as moderator at the II International Compliance Congress, organized by the Argentine Association of Ethics and Compliance and Thomson Reuters, held on October 25, 2017 at the Buenos Aires Stock Exchange Building, in the panel which addressed “The criminal liability of legal entities. The vision from the perspective of the Argentine justice”.

 

He was also a lecturer – together with other members of the Argentine Association of Ethics and Compliance – in the training seminar for Judges and Prosecutors, aimed at evaluating integrity programs, carried out at the UCEMA University on June 7th and November 6th, 2017. He was also a speaker at the Seminar “How to prepare to comply with the law of criminal liability of legal persons for corruption offenses, and not die in the attempt,” held at UCEMA on December 5th, 2017.

Finally, he was speaker at the Seminar organized by Thomson Reuters, aimed at analyzing the corporate criminal liability law, carried out at the Hotel Novotel, on December 11th, 2017.

Dr. Munilla Lacasa published, on Abogados.com (19514), on March 1st, 2nd and 3rd, 2017, the article entitled “In search of adequate compliance”

 and in the legal magazine La Ley the article “Integrity programs in the new criminal law of business: its scope and form of evaluation” on November 27th, 2017, Volume 2017-F (Special Edition: “Legal Entities Criminal responsibility”).

Also, in the newspaper La Nación he published, on May 26th, 2017 the opinion note “Business Transparency. Honesty must be encouraged”, and on November 5, 2017 “Independent monitor: an alternative control for companies”(Economy supplement).

The law firm also provides training to various private companies, based on the guidelines, scope and contents of the criminal liability of legal entities law, especially focusing on the consistency of the integrity programs and their how to evaluate them.
